TERMS AND CONDITIONS

1. INTRODUCTION
 

Welcome to Atelier Mounts ("Company," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our website and your purchase of custom guitar frames and related products (the "Products"). By accessing our website and/or making a purchase, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or purchase our Products.
 

2. PRODUCT SPECIFICATIONS & CUSTOMIZATION
 

2.1 Custom Orders Are Non-Refundable After Confirmation

All frames are handcrafted to your exact specifications and customizations. Once your order is placed and confirmed (you will receive a confirmation email), the frame is assigned to production. Customization choices—including fabric, frame finishes, dimensions, and color selections—are final and non-refundable.
 

2.2 Production Timeline

All custom frames require 4–6 weeks for production. This timeline begins immediately upon receipt of payment and completion of your order form. We do not guarantee a specific delivery date; the 4–6 week estimate is approximate and subject to production queue and material availability.
 

2.3 Design & Material Accuracy

We make reasonable efforts to match your requested materials and finishes (e.g., "Theta Barley" fabric, "CMI 9381" walnut-tone frame) as closely as possible. However, minor variations in color, grain, or texture may occur due to manufacturing tolerances and natural material variation. These variations are not grounds for rejection or refund. If you have concerns about material accuracy before production begins, you must contact us within 24 hours of order confirmation.
 

2.4 Approval Before Production

You will receive a digital mockup or sample approval request before production begins. You must approve or request modifications within the timeframe specified in your approval email. Failure to respond constitutes acceptance of the design as shown.
 

3. PRICING & PAYMENT

3.1 Pricing

All prices are in U.S. dollars and include applicable sales tax for California residents. Prices are subject to change without notice, but such changes will not affect orders already placed and paid for.

3.2 Payment Structure

Payment for custom frames is collected in two installments:

Deposit (30%): Due at the time of material and design selection. This non-refundable deposit secures your materials, frame specifications, and production slot.

Final Balance (70%): Due upon order confirmation, before production begins. Once the final balance is received, your frame is locked into production and cannot be modified or cancelled.

3.3 Deposit Details

  • The 30% deposit is non-refundable and non-transferable, even if you cancel your order before production begins.

  • The deposit secures your selected materials (fabric, frame finishes, dimensions, colors) for a period of 30 days. If the final balance is not received within 30 days, your design selections expire and your deposit is forfeited.

  • If you wish to restart with new material selections after 30 days, a new 30% deposit will be required.

3.4 Final Balance Details

  • The final balance must be received in full before production commences.

  • Once the final balance is paid and your order is confirmed (you will receive a confirmation email), the frame is assigned to production and is non-refundable and non-modifiable (see Section 2.1).

  • If the final balance is not received within 30 days of the deposit, your design holds will be released and your deposit forfeited.

3.5 Payment Methods

We accept credit cards, PayPal, and other payment methods as indicated at checkout. By providing payment information, you represent that you are authorized to use the payment method and that all information provided is accurate.

3.6 Payment Processing

  • Deposit Payment: Processed immediately upon submission at checkout.

  • Final Balance Payment: Processed immediately upon order confirmation.

  • Both payments are final once processed. Chargebacks or payment reversals may result in cancellation of your order and forfeiture of your deposit.

3.7 Non-Refundable Payments

Once the deposit is submitted, all payments are non-refundable, except as required by law or in cases of Company error or manufacturing defect (see Section 5: Warranty & Defects). The 30% deposit is explicitly non-refundable and is considered payment for securing your material selections and production capacity.

3.8 Taxes

If you are exempt from sales tax, you must provide valid documentation at the time of purchase. We are not responsible for any sales taxes owed by you if you fail to provide proper documentation. Sales tax is calculated on the full order price and is due with the final balance payment.

3.9 Payment Plan Modifications

Atelier Mounts reserves the right to modify payment terms for future orders. Such modifications will not affect orders already placed and confirmed.

4. SHIPPING & DELIVERY
 

4.1 Shipping Costs

Shipping costs are calculated at checkout based on:

  • Destination zip code

  • Dimensions and weight of your frame

  • Carrier and service level selected

Shipping costs are non-refundable once an order has been placed and confirmed for production.
 

4.2 Shipping Methods

We partner with third-party carriers (UPS, FedEx) to deliver your frame safely. You will select your preferred shipping method at checkout (Standard, Expedited, or Overnight). Estimated delivery times are provided but are not guaranteed.
 

4.3 Delivery Address

You are responsible for providing a complete and accurate delivery address. We are not responsible for delivery failures due to incomplete or incorrect address information provided by you.
 

4.4 Signature & Delivery Confirmation

Depending on the value and shipping method, signature may be required upon delivery. You are responsible for ensuring someone is available to receive the package. If the package is left unattended and subsequently lost or stolen, we are not liable.
 

4.5 Damage in Transit

Inspect your package immediately upon receipt. If the frame arrives visibly damaged:

  1. Do not discard packaging materials.

  2. Take clear photographs of the damage and the exterior box.

  3. Contact us within 48 hours of delivery with photographic evidence.

We will file an insurance claim with the carrier on your behalf. Failure to report damage within 48 hours may result in a denied claim.
 

4.6 Lost Shipments

If your frame does not arrive within the estimated delivery window, contact us immediately. We will investigate with the carrier and work toward resolution, including replacement or refund (minus non-refundable shipping costs) once the carrier claim is resolved. The Company is not liable for delays caused by the carrier, weather, or circumstances beyond our control.
 

4.7 International Shipping

At this time, we ship only to addresses within the continental United States. International shipping is not available.
 

5. WARRANTY & DEFECTS
 

5.1 Limited Warranty

We warrant that each frame is manufactured in accordance with the specifications provided at the time of order and is free from manufacturing defects in materials and workmanship under normal use. This warranty is valid for 30 days from the date of delivery.
 

5.2 Warranty Coverage

The warranty covers:

  • Manufacturing defects (e.g., structural failure, loose joints, adhesive failure)

  • Finish defects (e.g., bubbling, peeling, cracking in protective coatings)

The warranty does not cover:

  • Normal wear and tear

  • Damage from improper handling, storage, or installation

  • Damage from environmental factors (humidity, temperature fluctuations, sunlight exposure)

  • Damage from attempted repairs by anyone other than Atelier Mounts

  • Cosmetic variations (color, grain variation, minor finish variations)
     

5.3 Warranty Process

To claim warranty coverage:

  1. Contact us within 30 days of delivery with photographic evidence of the defect.

  2. Provide a detailed description of the issue and how it occurred.

  3. We will evaluate the claim and either:

    • Provide a replacement frame (we will cover shipping for the replacement; you cover return shipping)

    • Provide a refund of the frame price only (minus original non-refundable shipping costs)
       

5.4 No Other Warranties
 

DISCLAIMER: We make no other warranties, express or implied, regarding the Products. The Products are provided "as is" and "as available." We disclaim all other warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
 

6. RETURNS & REFUNDS
 

At Atelier Mounts, every frame is custom-built to your exact specifications — your chosen materials, dimensions, hardware, and approved design. Because of the bespoke nature of our work, our return and refund policy reflects the care, craftsmanship, and materials committed to each individual order.

Please read this policy carefully before placing your order. By submitting a Build Your Masterpiece order, you acknowledge and agree to the terms below.

 

6.1  Return Policy for Custom Orders

Because all frames are custom-made to your specifications, we do not accept returns or exchanges on custom orders except in the following limited circumstances:

 

  • Company error — for example, we shipped the wrong frame, wrong size, or incorrect materials from what was approved

  • Manufacturing defect covered under our Limited Warranty (Section 5)

  • The frame arrives damaged in transit (see Section 4.5 for transit damage procedures)

 

In all other circumstances — including dissatisfaction with the appearance, a change of mind, or buyer's remorse — the order is considered final. This is consistent with industry practice for custom-fabricated goods and is why we provide a full design approval process (including a 2D CAD drawing and a generated final image with one revision) before any order proceeds to production.

 

⚑  Important: Design approval is your final confirmation. Once you approve the design and production begins,

     the order cannot be cancelled, modified, or refunded on the basis of aesthetic preference.

 

6.2  Return Shipping

If a return is approved because of a Company error or a confirmed manufacturing defect, Atelier Mounts will cover return shipping costs. In all other approved return scenarios, return shipping costs are the responsibility of the customer and are non-refundable.

 

We strongly recommend using a trackable, insured shipping method for any return. Atelier Mounts is not responsible for items lost or damaged in return transit.

 

6.3  Return Address & Packaging Requirements

Returns are not accepted without prior written approval from Atelier Mounts. If your return is approved, we will provide you with a return authorization and the appropriate shipping address.

 

All returns must meet the following conditions:

 

  • The frame must be returned in its original packaging or equivalent protective materials

  • The frame must be in the same condition as received — unaltered and undamaged

  • A copy of your return authorization must be included inside the package

 

Any damage that occurs during return shipment due to inadequate packaging is the sole responsibility of the customer and may disqualify the return from processing.

 

6.4  Refund Processing

Once your return is received and inspected by our team, we will notify you of the outcome within 3 business days. If approved, refunds will be processed within 10 business days of that notification.

 

All refunds are issued to the original payment method used at the time of purchase. Please allow additional processing time (typically 3–7 business days) for your bank or card issuer to reflect the credit.

 

Note: Atelier Mounts will not issue refunds to a different payment method, account, or person

than the one used in the original transaction.

 

6.5  Non-Refundable Circumstances

Refunds are expressly not available in the following situations:

 

  • Dissatisfaction with the final appearance or design — you reviewed and approved the design prior to production

  • Change of mind, buyer's remorse, or regret after production has begun

  • Damage caused by improper handling, installation, or storage by the customer or a third-party installer

  • Failure to follow our installation recommendations (professional installation is strongly advised for all frames)

  • Natural variations in wood grain, fabric texture, or material finish that are consistent with the materials approved

 

If you have any concerns about your order before approving the final design, we encourage you to reach out directly — we would rather address a concern early than have any customer disappointed after production. One design revision is included at no charge as part of our standard process.

7. LIMITATION OF LIABILITY
 

7.1 No Liability for Indirect Damages

To the fullest extent permitted by law, Atelier Mounts shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages

  • Loss of profits, revenue, or business opportunity

  • Emotional distress, loss of enjoyment, or diminished aesthetic value

  • Any damages arising from your use (or inability to use) the Products

7.2 Liability Cap

Our total liability to you for any claim arising from these Terms or your purchase shall not exceed the price you paid for the Product.

7.3 Inapplicability of Limitation

This limitation of liability does not apply to:

  • Our gross negligence or willful misconduct

  • Claims that cannot be limited under applicable California law

8. INTELLECTUAL PROPERTY

8.1 Our Intellectual Property

All content on our website—including logos, photographs, product descriptions, designs, and layout—is the exclusive property of Atelier Mounts and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, or display this content without our express written permission.

8.2 Customer Design Rights

When you provide us with design specifications, photographs, or other materials for your custom frame, you represent and warrant that:

  • You own or have the right to use all such materials

  • Your materials do not infringe on any third party's intellectual property rights

  • Your materials do not contain defamatory, obscene, or otherwise unlawful content

8.3 License to Us

By providing materials to us for production, you grant Atelier Mounts a non-exclusive license to use those materials solely for the purpose of manufacturing your frame. We may use photographs of completed frames (without identifying information) for marketing purposes, unless you opt out at the time of purchase.

9. USER CONDUCT & PROHIBITED ACTIVITIES

You agree not to use our website or Products for any unlawful purpose or in violation of applicable laws. Specifically, you agree not to:

  • Attempt to damage, disable, or impair our website

  • Reverse-engineer, decompile, or attempt to derive our business methods

  • Scrape or collect data from our website without permission

  • Impersonate others or misrepresent your identity

  • Harass, threaten, or defame any person or entity

  • Post spam, phishing links, or malicious content

10. DISPUTE RESOLUTION & GOVERNING LAW

10.1 Governing Law

These Terms and all matters arising from your use of our website or purchase of Products shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

10.2 Jurisdiction & Venue

You agree to submit to the exclusive jurisdiction of the state and federal courts located in Orange County, California for the resolution of any disputes.

10.3 Informal Resolution

Before initiating any legal action, you agree to contact us at info@ateliermounts.com attempt to resolve the dispute informally. We will make reasonable efforts to resolve the dispute within 30 days.

10.4 Small Claims Court

Notwithstanding the above, either party may bring an action in small claims court if the claim qualifies under that court's jurisdiction.

10.5 Class Action Waiver

You agree that any legal action or proceeding shall be brought only on an individual basis and not on a class or representative basis. You waive your right to participate in a class action.

11. PRIVACY & DATA PROTECTION

Your use of our website is also governed by our Privacy Policy [INSERT LINK]. Please review our Privacy Policy to understand our practices regarding your personal information, including how we collect, use, and protect your data in compliance with the California Consumer Privacy Act (CCPA) and other applicable laws.

12. MODIFICATIONS TO THESE TERMS

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our website or purchase of Products after modifications constitute your acceptance of the updated Terms. We encourage you to review these Terms periodically.

13. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

14. ENTIRE AGREEMENT

These Terms, along with our Privacy Policy and Shipping Policy, constitute the entire agreement between you and Atelier Mounts regarding your use of our website and purchase of Products. Any prior discussions, negotiations, or understandings are superseded by these Terms.
